Warranty, Remedy, Disclaimer

Compressor Service & Sales, Inc. warrants for a period of one year from the date of shipment, new equipment of its own manufacture to be delivered hereunder against defects in material and workmanship. Equipment, parts or assemblies not of Compressor Service & Sales, Inc. manufacture are warranted only to the extent that they are warranted by the original manufacture. Compressor Service & Sales, Inc. warrants for a period of ninety days from the date of shipment all repaired equipment against defects in material and workmanship. This warranty takes exceptions to new compressor elements, which will be warranted from the date of start-up and warranty validation by a factory representative for a period of one year, 12 months. This warranty is valid only for equipment under normal use and service, when used and maintained with genuine factory parts in accordance with instructions supplied by the original manufacture.

If such defects appear within the specified warranty period from the date of shipment and Purchaser has given Compressor Service & Sales, Inc. immediate written notice of same, Compressor Service & Sales, Inc. will repair the part, or at it’s option replace the part, by shipping a similar part F.O.B. shipping point, or option refund an equitable portion of the purchase price. Compressor Service & Sales Inc. may require return of the defective part, transportation prepaid, to establish the claim. No allowance will be made for repairs without Compressor Service & Sales, Inc. written consent or approval. Any description of the equipment, any specifications and any samples, models, bulletins, or similar material, used in connection with this repair are for the sole purpose of identifying the equipment and are not to be construed as express warranties. Compressor Service & Sales Inc. makes no other warranty of any kind, whatsoever, expressed or implied, and all warranties or merchantability and fitness br a particular purpose are hereby disclaimed by Compressor Service & Sales, Inc. and excluded from these conditions of sale. There are no warranties, which extend beyond the description of the face hereof. The Purchaser’s sole and exclusive remedy, whether good upon warranty, contract or tart, including negligence, will be to proceed under this warranty. All liability of Compressor Service & Sales, Inc. shall terminate within the specified warranty period from date of shipment.
